These Terms govern your access to and use of QuestionStock, including its website, quiz workspace, exports, and developer API.

1. Acceptance of these terms

By accessing or using QuestionStock (the “Service”), you agree to these Terms and any policies referenced here (including our Privacy Policy).

If you are using the Service on behalf of an organisation (for example, in an organisation workspace), you represent that you have the authority to bind that organisation to these Terms.

2. Definitions

For clarity, the following terms are used throughout these Terms:

  • Service: the QuestionStock website, quiz workspace, exports, and developer API.
  • Workspace: a user workspace or organisation workspace associated with your account.
  • Content: any text, images, questions, categories, exports, metadata, and other materials made available through the Service.
  • Shared question library: approved stored questions that can be served, reused, edited, and exported.
  • Quiz: a saved, ordered selection of questions and settings associated with a workspace.
  • Export: a generated file (such as PDF or PPTX) created asynchronously from a quiz.
  • API key: a secret credential that authenticates developer API requests for a workspace.
  • Paid plans: plans that unlock additional features (such as Pro and Business), typically based on entitlements.
  • Third-party services: external providers we use to deliver the Service (for example hosting, auth, storage, AI, and analytics).

3. Who we are (contracting party)

QuestionStock is operated by Alec Ambrosino, a sole proprietor based in England, United Kingdom.

We operate under the trading name “QuestionStock”.

4. Eligibility

You must be at least 13 years old to use the Service (or older if required by applicable law).

If you use the Service in connection with minors (for example, in an educational setting), you are responsible for obtaining all necessary permissions and for compliance with applicable laws and policies.

5. Accounts, workspaces, and roles

Account registration and sign-in are provided through a third-party authentication provider. You are responsible for maintaining the security of your account and for all activity that occurs under your account.

The Service supports both personal workspaces and organisation workspaces. In organisation workspaces, owners and admins may have additional permissions (for example managing API keys and upgrade actions). Workspace members must comply with these Terms and any workspace policies.

We may suspend or restrict access to protect the Service, investigate suspected abuse, or comply with legal obligations.

6. The service

QuestionStock is a quiz-building service powered by a shared question library. It is not a quiz game.

The Service is designed around reusable approved questions: questions are generated or submitted ahead of time, validated, stored, and reused across quizzes and API requests.

Some parts of the Service rely on automated systems (including AI) and asynchronous background processing. As a result, certain actions (such as exports or image generation) may take time, fail, or be delayed.

7. Plans, upgrades, and billing

The Service may offer multiple plans, including Free, Pro, and Business. Feature access may be controlled by workspace entitlements.

Upgrade and billing flows may be provided through third-party services and may occur outside the core application experience. Pricing, entitlements, and features may change over time.

Refunds: fees are non-refundable except where required by law. We may provide credits or discretionary refunds in exceptional cases.

Bespoke enterprise arrangements may be governed by a separate written agreement. If there is a conflict between these Terms and a bespoke enterprise agreement, the bespoke enterprise agreement will control for that scope.

8. Developer API terms

Developer API access may require a paid workspace entitlement. API requests must be authenticated using an API key.

By creating or using an API key, you agree to these Developer API terms.

  • You must keep API keys secret. Do not share keys publicly or embed them in client-side code.
  • You are responsible for all activity performed with your API keys, including activity by authorised users or third parties you share the key with.
  • Rate limits and usage quotas may apply and may change. Requests that exceed limits may be rejected.
  • You must not circumvent rate limits or quotas (for example by rotating keys to evade enforcement) or attempt to scrape or bulk extract content to recreate the shared library.
  • You may use API results to run your quiz experiences and products, but you may not resell, sublicense, publish, or create a competing database from the Content, except as permitted by a bespoke enterprise agreement.

9. Submissions, moderation, and contribution license

The Service may allow you to submit categories, questions, text, and other materials (“Submissions”). Submissions can be validated, moderated, deduplicated, and edited before acceptance.

You understand that approved Submissions may become part of the global shared question library and may be reused across quizzes, direct-link pages, exports, API responses, and other service surfaces. Quiz visibility settings (including “private”) control quiz access, but do not prevent approved Submissions from being incorporated into the shared question library.

You represent and warrant that you have all necessary rights to make your Submissions and that your Submissions do not infringe third-party rights or violate applicable law.

You grant QuestionStock a worldwide, perpetual, irrevocable, sublicensable, royalty-free licence to host, store, reproduce, modify, adapt, combine, publish, distribute, and display your Submissions to operate, secure, improve, and provide the Service, including moderation workflows and publication to the shared question library.

These rights continue as needed to keep already-published shared-library content available and to maintain audit, compliance, and system-integrity records, even after account closure or deletion requests where legally permitted.

Do not submit confidential information, trade secrets, or sensitive personal data you do not have the right to share.

10. AI and content quality

Some Content may be generated, transformed, validated, or moderated using automated systems (including AI). These systems can produce incorrect, incomplete, or biased outputs.

We do not guarantee the accuracy, uniqueness, suitability, or appropriateness of any Content for any particular audience or event. You are responsible for reviewing quizzes and exported materials before public or commercial use.

We may edit, disable, reject, or remove Content at any time, including for quality, policy, safety, legal, or operational reasons.

11. Exports, files, and storage

Exports (such as PDF and PPTX files) are generated asynchronously. Export generation may be queued, delayed, fail, or be retried.

Files and images may be stored in third-party object storage. Download links may be signed and time-limited and may expire.

We may delete old export artifacts and stale assets as part of normal operations. If you require long-term retention, you are responsible for downloading and storing your exports.

12. Acceptable use

You agree not to misuse the Service. In particular, you must not:

  • use the Service for unlawful, harmful, or abusive purposes
  • upload or submit content that infringes intellectual property, violates privacy, or contains personal data you lack rights to share
  • attempt to interfere with or disrupt the Service (including by load testing without permission)
  • attempt to access non-public areas of the Service, bypass authorisation checks, or probe for vulnerabilities without permission
  • reverse engineer or attempt to derive source code or underlying models except to the extent prohibited by applicable law

13. Third-party services

The Service relies on third-party services for core functionality. Depending on configuration and environment, this may include providers for authentication, hosting, databases, object storage, background jobs, AI generation, monitoring, analytics, and email.

Third-party services may have their own terms and policies. While we aim to operate the Service reliably, we are not responsible for third-party outages or failures outside of our control.

14. Intellectual property and service license

We (and our licensors) own the Service, including branding, designs, and the underlying software, excluding your Submissions and any third-party materials.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the Service for its intended purpose.

Nothing in these Terms transfers ownership of QuestionStock intellectual property to you.

15. Suspension, termination, and survival

We may suspend or terminate your access to the Service if you breach these Terms, create risk for the Service or other users, or if we must do so to comply with applicable law.

On suspension or termination, your API keys may be revoked and downloads, exports, or links may stop working. We may delete data and artifacts as part of normal operations, subject to applicable law and our internal policies.

Sections that by nature should survive termination (including intellectual property, submissions license, disclaimers, liability limits, indemnity, and governing law) will survive.

16. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of satisfactory quality, fitness for a particular purpose, and non-infringement.

Nothing in these Terms limits any rights you may have under applicable consumer protection laws.

17. Limitation of liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

Subject to the paragraph above, to the maximum extent permitted by law, we will not be liable for indirect or consequential losses, loss of profits, loss of revenue, loss of business, loss of goodwill, or loss of data.

Our total liability for all claims relating to the Service will not exceed the greater of: (a) the fees you paid to us for the Service in the 12 months before the event giving rise to the claim, or (b) GBP £500.

18. Indemnity

You agree to indemnify and hold harmless QuestionStock and its operators from and against claims, damages, losses, and expenses (including reasonable legal fees) arising from your Submissions, your use of the Service, or your violation of these Terms or applicable law.

19. Governing law and venue

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, except where mandatory consumer laws provide otherwise.

20. Changes to these terms

We may update these Terms from time to time. We will post the updated version on this page and update the “Last updated” date. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
